Cancellation, Refund and Termination Policy – Employers/Clients and Freelancers
1. Employers/Clients
1.1 The Jobboard’s role in relation to businesses
The Jobboard is an online marketplace. We bring employers/clients and freelancers into contact with one another, but are not, in principle, a party to the agreements they enter into with one another (employment contracts, service agreements or other arrangements).
This policy relates exclusively to: The policy does not relate to the mutual agreements between employers/clients and freelancers.
- the use of the platform by employers/clients;
- free job listings; and
- the paid services Perfect Match and Full Match.
1.2 Free job listings
Employers/clients can post free job listings on the platform.
- No cancellation, refund or termination policy is required for free job listings, as no fee is paid for posting them.
- Amending, deactivating or deleting a free job listing does not entitle the user to any form of refund or compensation.
1.3 Paid services: Perfect Match and Full Match
Perfect Match and Full Match are paid, one-off services: the service is deemed to have been completed as soon as the employer/client has received the following from Allround The Agency:
- Perfect Match: Allround The Agency draws up a shortlist of suitable freelancers;
- Full Match: Allround The Agency handles the entire selection process and provides one selected freelancer.
- a shortlist of suitable freelancers (Perfect Match); or
- one specific selected freelancer (Full Match)
Failure to reach an agreement with the proposed freelancer(s) does not render the service incomplete.
1.3.1 Cancellation
Once payment has been made, the assignment cannot be cancelled free of charge.
- Cancellation prior to the commencement of work (e.g. before the intake or before the start of the selection process) is only possible with the written consent of Allround The Agency.
- In such cases, a refund is not a right, but a possible gesture of goodwill. Allround The Agency decides on a case-by-case basis whether to offer a (partial) refund or a credit.
1.3.2 No refund after completion
This is a one-off service.
- The service is considered complete as soon as the employer/client has received a shortlist of freelancers or a single selected freelancer.
- From that point onwards, no refund is possible, even if the employer/client decides not to hire a freelancer or if the collaboration is terminated at a later date.
1.3.3 Termination
As Perfect Match and Full Match are one-off services, there is no ongoing subscription that needs to be cancelled.
- Upon delivery (shortlist or selected freelancer), the service ends by operation of law.
- Any further support or communication is optional and does not confer any additional rights to a refund or termination.
2. Freelancers
2.1 The Jobboard’s role in relation to freelancers
The Jobboard is an online marketplace. We bring freelancers and employers/clients into contact with one another, but are not, in principle, a party to the agreements they enter into with one another (employment contracts, contracts for services or other arrangements).
This policy relates exclusively to:
- the use of the platform by freelancers;
- free accounts; and
- paid subscriptions for freelancers.
The policy does not apply to mutual agreements between freelancers and employers/clients.
2.2 Free accounts
Freelancers can create an account free of charge.
- With a free account, freelancers can be found by Allround The Agency as a match for companies.
- No cancellation, refund or termination policy is required for free accounts, as no fee is paid.
- The deletion or deactivation of a free account does not entitle the holder to any form of refund or compensation.
2.3 Paid subscriptions
Freelancers can choose from paid subscriptions: These subscriptions are ongoing services with recurring payments (e.g. monthly or annually, as stated in the price list).
- Subscription: Access to job listings: access to all job listings posted by companies, with the option to apply for them.
- Job Listings + Guidance Subscription: access to all job listings plus one-to-one guidance from Allround Match Hub.
2.3.1 Cancellation and termination
Freelancers may cancel their subscription. The cancellation takes effect from the next payment period, unless otherwise stated in the subscription terms and conditions.
- Cancellation prevents future renewals and future payments.
- Subscription fees already paid will not be refunded.
2.3.2 Upgrading a subscription
Freelancers can upgrade to a higher-tier subscription at any time (for example, from “Access to job listings” to “Access to job listings + guidance”).
- Upon upgrading, the new, higher-tier subscription takes effect immediately (or from the next billing period, as stated in the subscription terms and conditions).
- Amounts already paid for the previous subscription will not be refunded.
- No refund will be given for the remaining period of the old subscription.
2.3.3 Downgrading a subscription
Freelancers can downgrade to a lower subscription at any time.
- Upon downgrading, the current (higher) subscription and its associated features remain available until the end of the period for which payment has already been made.
- From the next payment period onwards, the lower subscription fee and the associated features will apply.
2.3.4 No refunds for upgrades or downgrades
- In the event of an upgrade, no refund is payable for amounts already paid under the previous subscription.
- In the event of a downgrade, no refund is payable for the price difference for the current period; the lower amount will only apply from the next payment instalment.
2.3.5 Right of withdrawal
If and insofar as freelancers qualify as consumers and a distance contract applies, a statutory cooling-off period (right of withdrawal) may apply.
- In such cases, Allround The Agency will explicitly state in the terms and conditions and in the order process whether and how the right of withdrawal applies.
- For self-employed freelancers who qualify as business users, the right of withdrawal may be excluded, in accordance with the statutory rules.
